Who Do We Share It With?

If we are unable to resolve hardware faults, we may, with your consent, share your contact details with the manufacturer for further investigation. Additionally, when you order a home charger, we will share your details with our contractors to facilitate the installation.
How Long Do We Keep Your Information?
In Short: We retain your information for as long as necessary to fulfil the purposes outlined in this privacy policy, unless otherwise required by law.
We will only keep your personal information for as long as it is needed for the purposes specified in this policy, unless a longer retention period is required or permitted by law (such as for tax, accounting, or other legal obligations).
When we no longer have a legitimate business need to process your personal information, we will either delete or anonymise it. E-Charge App Terms & Conditions
Introduction
We are E-Charge, a company registered in the UAE, providing electric vehicle (EV) charging services to our customers. We offer a network of charging stations through our platform. For more information about our services, please visit our website at https://echarge.ae/.
By using the E-Charge platform, including the mobile application and related services, you agree to the following Terms and Conditions. Please read them carefully before using our services.

Terminology Explained
- Ad-Hoc Payment or PAYG: Refers to the pay-as-you-go payment method used for charging your electric vehicle at any of our charging points.
- Auto Top-Up: A service that allows you to authorise automatic payments to top-up your E-Charge account using the debit/credit card linked to your account.
- Carbon Credit: Any unit, benefit, or entitlement related to reducing or offsetting greenhouse gas emissions.
- Carbon Credit Scheme: Refers to any voluntary or regulatory program related to reducing or offsetting emissions. This includes the creation, transfer, or renewal of carbon credits.
- Charge Point: The EV charging stations within the E-Charge network that you may use to recharge your vehicle. Locations of these charge points will be visible in the E-Charge app.
- Commencement Date: The date you successfully register on the E-Charge platform and receive an acknowledgment from us via email.
- E-Charge Account: Your personal account within the E-Charge platform where your credits (Units) are stored. Your account balance will be used to pay for services provided by E-Charge.
- E-Charge Card: A physical RFID card, available to certain users, that provides a convenient way to access and use E-Charge charge points without requiring a mobile device.
General Terms
- Registration and Account
- By completing the registration process on the E-Charge app, you accept these Terms and Conditions.
- You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- Services Provided
- E-Charge provides access to charge points for EVs, along with additional services such as payment processing for usage, account management, and the ability to purchase Carbon Credits, where applicable.
- Payments and Charges
- Charges for services are deducted from your E-Charge Account balance, which can be topped up using credit or debit cards.
- Payment is processed in accordance with UAE laws, including the use of secure payment gateways for financial transactions.
- Data Privacy
- We collect personal data in accordance with applicable UAE data protection laws. You agree to our collection and use of your data as described in our Privacy Policy.
- Carbon Offset Program
- You may choose to participate in our Carbon Credit Scheme to offset the emissions associated with your charging activities. The details of how this program works and its benefits are outlined in our website and app.
Liability and Disclaimers
- E-Charge is not liable for any damages or losses resulting from your use of the charging points, including any service interruptions or technical issues with the charging stations.
- The availability of charge points is subject to network capacity and operational status. We do not guarantee the availability of charging points at all times.
Termination of Services
- You may cancel your E-Charge account at any time by contacting our customer service team. We reserve the right to terminate your access to the services in case of any violations of these Terms and Conditions.

Data Protection Legislation
Refers to:
(i) The Data Protection Act 2018 (“DPA 2018”);
(ii) The Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”);
(iii) The General Data Protection Regulation (EU) 2016/679, as adopted into domestic law in the UAE;
(iv) Any laws or regulations that give effect to or correspond to (i) – (iii) above; and
(v) Any laws that replace, extend, re-enact, consolidate, or amend such laws.
References to Personal Data and Sensitive Personal Data shall have the meanings set out in the applicable UAE data protection laws.
Event Outside Our Control
Is defined in Clause 11 of the Terms and Conditions.
Fees / Charges
Refers to the amounts payable by you in connection with your use of a Charging Point and the electricity supplied by us for recharging your electric vehicle. The charges are based on the published tariffs, as described in accordance with Clause 5.
Recurring Payment Authority
Means an arrangement you enter into with us and your bank, where you authorise us to take top-up payments from your debit/credit card, controlled by you. These payments are solely for adding pay-as-you-go credit (Units) to your E-Charge Account.
Registration Process
The process by which you register online via the application.
Services
Refers to the services provided by us under these Terms, along with any additional services we provide or agree to provide to you in writing.
Terms
Means these Terms and Conditions (as amended from time to time), which constitute the contract between you and us and set out the basis upon which we provide our Services and access to the Charge Points that you use.
VAT
Value Added Tax, chargeable under UAE Law for the time being, and any similar additional tax.

- Our Agreement with You
1.1. These terms and conditions govern the provision of our services to you.
1.2. Please review these terms carefully before registering with us as a customer.
1.3. These terms become binding on both parties when you complete the registration process.
1.4. Your use of the E-Charge network and services, including access to charging stations via an E-Charge Card or mobile app, is subject to your compliance with these terms.
1.5. You confirm that all information you provide to us is accurate and complete. You agree to inform us promptly if any details change.
2. Changes to These Terms
2.1. We may modify these terms for several reasons, including:
2.1.1. Changes in applicable UAE laws and regulations;
2.1.2. Adjustments in the way we accept payments for our services;
2.1.3. Any changes in our business model or operational approach;
2.1.4. Any events that affect our ability to deliver the services as agreed;
2.1.5. Any other reasonable situation that necessitates a change to these terms.
2.2. If we need to amend these terms, we will notify you at least 14 days before the new terms take effect. If you do not accept the revised terms, you may cancel your contract as per the cancellation rights in clause 8.
3. Provision of Services
3.1. We will provide services to you from the start date until these terms are terminated as specified in clauses 8 or 9.
3.2. We will make every effort to ensure services are provided promptly and efficiently. However, delays or interruptions may occur due to events outside our control (refer to clause 11).
3.3. We may need to modify, limit, or suspend our services, either in part or in full, due to technical issues affecting our charge points.
3.4. If you fail to pay for the services on time, we reserve the right to suspend services until the overdue payment is received.
4. Customer Registration, Accounts, and Payments
4.1. You must complete the registration process, which includes providing personal information. We are required under UAE data protection laws to inform you about how your personal data is processed. This information is provided in our privacy policy.
4.2. To use our charging stations, you will need to provide valid debit or credit card information. Please note:
4.2.1. We use secure encryption for payment processing to protect your card details;
4.2.2. We accept payments only in AED (UAE Dirhams);
4.2.3. We accept payments through Visa, MasterCard, Maestro, Solo, and American Express.
4.2.4. All payments are subject to authorisation by your payment provider.
4.3. To use a charge point, you will need to top up your E-Charge account via the mobile app.
4.4. The default top-up method is an automatic top-up system. By registering, you authorise us to charge your card whenever your account balance falls below a specified threshold, automatically topping it up to AED 50.
4.5. We will send an email notification within 48 hours each time your account is topped up.
4.6. If you choose to opt out of auto top-up and switch to ad-hoc payments or pay-as-you-go (PAYG), your account may go into a negative balance if you fail to add credit.
4.7. You can view your balance in the E-Charge app under the “Balance” section.
4.8. Failure to update your payment details will result in the suspension of services.
4.9. You are responsible for maintaining the confidentiality of your username and password and preventing unauthorised access to your account. You must immediately notify us if you suspect any unauthorised access to your account.
5. Fees and Payment
5.1. The fees for using our charging points depend on the electricity consumed, the time spent at the charging station, and the specific charge point used.
5.2. Our fees are displayed at each charge point and communicated via the app. These fees include VAT and any applicable local charges.
5.3. After each charging session, you will receive a notification summarising the charge duration, amount of electricity used, and the total cost. These details will also be available in your E-Charge account.
5.4. Additional fees, such as “overstay charges,” may apply if your vehicle remains connected to a charge point beyond the designated time. Overstay periods and fees will be clearly displayed in the app and at each charge point.
6. Issues with the Services
6.1. If you encounter any issues with the services or charge points, please contact us as soon as possible.
6.2. In cases where we do not own or directly manage a charge point, we will work with the relevant parties to address any technical issues.
6.3. As a consumer, you have rights under UAE law, and we are committed to ensuring that our services meet legal standards. These rights are not affected by these terms.

8. Your Right to Cancel and Refunds
8.1. You may cancel the contract with us at any time by notifying us via email. Your cancellation rights are in line with UAE consumer protection laws.
8.2. If you cancel within 14 days of the contract start date, we will refund any applicable fees, including the cost of the E-Charge card and any unused balance in your account.
8.3. If you cancel after the 14-day period, you will receive a refund for any unused services.
8.4. Refunds will be processed within 14 days of receiving your cancellation notice, using the payment method you originally used.
9. Our Right to Cancel and Refunds
9.1. We may cancel the contract at any time with 30 days’ notice in writing. If we cancel, we will refund any payments made in advance for services not yet delivered.
9.2. We may also cancel the contract with immediate effect if you:
9.2.1. Fail to provide pre-authorisation for recurring payments or fail to make payments as due;
9.2.2. Breach any material term of the contract and do not rectify the breach within 30 days after written notice.
10. Our Liability to You
10.1. If we fail to comply with these terms, we are liable only for losses that were foreseeable at the time of entering into the contract. We are not responsible for any unforeseeable damages.
10.2. Losses are considered foreseeable if they are an obvious consequence of our breach or if they were known to both parties at the time of the agreement.
10.3. We only provide services for personal, non-commercial use. We are not liable for any loss of profit, business interruption, or other commercial damages.
10.4. We do not exclude liability for:
10.4.1. Death or personal injury caused by negligence;
10.4.2. Fraud or misrepresentation;
10.4.3. Breach of implied terms regarding quality and fitness for purpose under UAE law.
11. Events Beyond Our Control
11.1. We are not liable for any failure or delay in providing services due to events outside our reasonable control, such as strikes, civil unrest, terrorism, natural disasters, or system failures.
11.2. If such events occur, we will notify you promptly and extend service timelines as necessary.
11.3. You may cancel the contract if an event outside our control continues for more than 6 weeks.
12. Carbon Reduction Initiatives
12.1. We aim to participate in greenhouse gas reduction projects, including carbon credit schemes, by using data from our charge points.
12.2. Charging data may be used to quantify emissions reductions and enable the creation and trading of carbon credits.
12.3. You agree that we own all charging data and have the exclusive right to use it for carbon credit calculations and environmental reporting.
12.4. This agreement remains effective for the duration of your contract with us and any subsequent periods required for carbon credit accounting.
13. Miscellaneous Terms
13.1. We may transfer our rights and obligations to another organisation, but this will not affect your rights under these terms.
13.2. You may transfer your rights or obligations to a third party only with our written consent.
13.3. This contract is between you and us; third parties cannot enforce its terms.
13.4. If any part of these terms is found to be invalid, the remaining clauses will remain in effect.
13.5. Failure to enforce any rights under these terms does not constitute a waiver of those rights.
13.6. These terms are governed by the laws of the UAE, and we both agree to submit to the jurisdiction of the UAE courts.
